Commerce National Bank (hereafter
referred to as “CNB”) has adopted the following Privacy Policy. It
is designed to protect the information that you have entrusted with us.
At CNB, we put our customers first and take pride in offering our
customers financial services that meet their individual needs. We
appreciate the trust our customers have in CNB, and place the highest
priority on our customers’ privacy. As a CNB customer, you can count
on responsible treatment of any personal information you share with us.
We recognize and respect our responsibility to protect you, our
customer, from unauthorized use of your private information.
Definitions
Nonpublic personal information means information about you
that we collect in connection with providing a financial product or
service to you.
An affiliate is a company we own or control, a company
that owns or controls us, or a company that is owned or controlled by
the same company that owns or controls us.
A nonaffiliated third party is a company that is not an
affiliate of ours.
CNB
We believe the confidentiality and protection of customer information is
one of our fundamental responsibilities. Therefore, all employees of CNB
are governed by a strict code of conduct, which includes the importance
of our customers’ rights and expectations of privacy. Only employees
with a “need to know” and parties that have a legal right are
authorized to have access to the information. Our employees are educated
as to the importance of this issue, and stern measures are used to
enforce it. CNB has security practices and procedures in place to ensure
the confidentiality of the information in accordance with its policy.
Collection of Information
Information used by CNB is collected from:
- Applications and other forms that you provide to us (nonpublic
personal information such as your name, address, Social Security
number, assets, income and investment objectives);
- Transactions you’ve conducted (information such as your account
balance, payment history, parties to transactions and credit card
usage);
- Nonaffiliated companies, external to CNB, on transactions you’ve
conducted (information such as your account balance, payment
history, parties to transactions and credit card usage);
- Credit reporting agencies and demographic data companies
(information such as your creditworthiness, credit history, and
demographic information);
- Public sources such as federal, state, or local records,
(information such as mortgage and other lien information).
We will limit the use and collection of information
about our customers to that which is necessary to administer our
business, to help us offer superior service, and to inform our customers
of additional products and services which may be of interest.
Information to Nonaffiliated Third Parties
When we conduct business with third parties, we require them to maintain
similar standards of conduct regarding the privacy of personally
identifiable customer information provided to them. We will not disclose
information to nonaffiliated third parties concerning your account with
us, except:
- When such disclosure is necessary to complete the transactions;
- To verify the existence and condition of your account for a third
party (such as credit bureau) as is permitted by law;
- To outside companies who perform services on our behalf, (such as
Internet bill payment, check printing);
- To comply with court order or applicable laws or regulations; or
- When you give us your written permission or request us to do so.
Information to Affiliated Parties
First Merchants Corporation owns all the voting common stock of Commerce
National Bank. Any company that is owned by First Merchants Corporation
is an “affiliate” or an “affiliated company” of all the other
companies that may be owned by First Merchants Corporation in the
future. Current affiliates are: CNBC Retirements Service Inc., First
Merchants Bank, First Merchants Bank-Hamilton County, First Merchants
Insurance Services, Decatur Bank & Trust Co., First National Bank of
Portland, First United Bank, Frances Slocum Bank, Lafayette Bank and
Trust Co., Madison Community Bank, Merchants Trust Company, Randolph
County Bank, and Union County National Bank.
Former Customers
If you end your relationship with CNB, we will adhere to the information
policies and practices described in this policy.
Links and Internet Privacy
Occasionally, we will link our website to other Internet sites as a
convenience to you, our customer. CNB will only link to sites that
uphold our corporate standards; however, we are not responsible for the
content of those sites, nor their policies for the collection of
customer information.
When you visit our website to view any pages and read product
information, you do so without telling us who you are and without
revealing any personal information. While we do not collect identifying
information about visitors to our site, we do use standard software to
collect information for the strict purpose of tracking activity on our
site. This allows us to better understand how many people use our site
and which pages and features are most popular. The only information we
normally collect and store is:
- The name of your Internet Service Provider,
- The website that referred you to us (if any),
- The date and time the pages were accessed, and
- The page or pages you requested.
There are instances where you may elect to provide us
with personal information from one of our request forms on the Internet.
This information cannot be transmitted to us via the Internet. You must
print the form and either fax it, mail it, or hand deliver it to CNB.
This information is used internally only for the purpose of fulfilling
the request or for contacting you directly and is not given or sold to
any other organization.
Some areas of our website may use a “cookie” temporarily stored in
your computer memory to allow the web server to log the pages you use
within the site and to know if you have visited the site before.
Access to Your Account Information
Access to your account information using our Internet banking software
is protected using a User ID and Password.
